Asked on Jun 01st, 2013 on Immigration - California
More details to this question:
Hi, I have a ten year multiple entry visa expiring in 2021. I entered USA in 12th December 2012 and I am allowed to stay here until 11th June 2013. I would like to extend my stay. There is only 5 days left. How do I do that? Can I also drive to Canada and stay overnight and come back in?

You can apply for an extension and submit evidence of why you need/want to extend your stay. There is no guarantee it will be granted, especially if your evidence is not compelling. Traveling to Canada will not do it. You will not be permitted to reenter the US and will need to go back to your home country directly from Canada.

You can file for an extension of the visitor visa but it is recommended that you do that 45 days before your visa expires. You can still file the extension if you give them a good reason for your decision to extend and why they should extend your stay. Whether or not your extension is approved is questionable. No the Canada trip will not give you another 6 months.

You can apply for extension using Form I-539. You need to file your application with USCIS with the proper filing fee and supporting documentation establishing good reasons for extending your stay as a visitor. The application has to be received by USCIS before the expiration of your I-94. To make sure that your reasons qualify for extension of stay, you should consult an immigration lawyer. You will not get a new I-94 with an extended validity date if you go to Canada and reenter after a day.

You an apply for an extension prior to the expiration date on the I-94 card. During the process, you can remain in the US legally. Going to Canada could be problematic. Always consult with an experienced immigration attorney.

If your B-2 extension request is received by CIS before the expiry of your I-94, it may be possible. I cannot say for sure. Driving to Canada may not be a good idea. and I suggest you seek competent attorney assistance.

Form I-539 is the application. You can certainly drive to Canada. There is never any guarantee they'll let you come back, even with a visa.
