How can I obtain status for me and my wife?

More details to this question:
My mother has her green card. I am 29 years old and married. I have a student visa and I am studying in the US. Also both my children are born in the US. One is 5 years old and the other is 8. I've been here under one month. My wife is also here as an f2 dependent. Is there anything my mother can do do to assist me in obtaining a green card for both my wife and me. We have US social numbers as we worked in the US legally before on visas.

No, not in any foreseeable future. Your mother will only be able to petition for you and your family once she is a US citizen because as a green card holder, she can only petition for unmarried children. Once she is a US citizen and petitions for you, the process will take about 6-7 years, during which time you have to be in valid status in the US in order to actually get a green card. I think it would be much easier for you or your wife to try to qualify for employment based visas based on your education and/or experience.

Both you and your wife if otherwise qualified should explore employment based immigration as a possible means of getting green card because, there is not much your mother can do for your green card in the near term. There is no provision for visas for married adult children of green card holders. and if your mother becomes a US citizen, she may file for you under the third family preference category F3 [married son/ daughter of a US citizen] Visas in that category have long waiting times. 11 years. There may be other options for a faster way to get a green card, but you must speak to an attorney.

Your mother will have to become a citizen and then petition for you. After she files a petition for you, you and your family will have to wait about 6 years before you are eligible to apply for green card.

Your mother cannot petition for you until she becomes a US citizen. There is no visa preference for married children of someone who is only a lawful permanent resident.
