QUESTION

How can I speed up my visa application?

Asked on Oct 23rd, 2011 on Immigration - Texas
More details to this question:
I am 18 years old. I was brought to the county when I was 3 years old. I have 2 other younger sisters, ages 12 and 9, and a brother, age 2. My mom applied for visa U and it is currently in process. My mom had to go back to Mexico and I am the guardian of my siblings. I have to work and drive but this is not possible. Is there a way I could speed up my status change?

It is not clear from your question what the basis of your change of status would be. In general, a change of status cannot be expedited.

If your mother's U visa has been approved, yours should not take long.

If your mother applied for the u-visa, the minor children can apply for derivative status. You should meet with an attorney as soon as possible.

No, there is no way to speed up the process for a U visa. These typically take some time as it is necessary to have a part of the I-918 certified by a Federal or State LEA. Please note that it is a short term nonimmigrant visa. If she has left the US, she may have abandoned her application for change of status and if you are a dependent beneficiary, your application for change of status cannot be approved. Consult immediately with another experienced immigration attorney.
