QUESTION

How do I check the status of my case?

Asked on Mar 09th, 2012 on Immigration - California
More details to this question:
I am a green card holder and filed for my husband in July 2011. I have a receipt number, but whenever I enter it to check the case status on USCIS website it doesn't show any record for the case neither get any record when I try to check it on phone. Please tell me does it take so long for the case to be in USCIS system? I am unable to check the status of my case.

It takes longer for application from residents of the United States than it takes from US citizens. The I-130 will be approved but the waiting time for the visa to become available can be of up to 5 years. I would recommend you file for citizenship and then update the records with USCIS on your husband's application so that it can be faster. In the mean time, your husband is at risk of being placed on deportation proceedings.

Some petitions are not really searchable online but if you have a receipt notice, you can try to call the USCIS to get an update. However, in most cases, there are no updates in the system until there is either a final decision or a request for evidence. In both instances you would be notified by the USCIS by mail as long as the USCIS has your current address on file. The online case status or the customer service representative would not really be able to give you any additional information.

In some circumstances the receipt numbers do not come up in the case status system online. However, you should be able to get information through the Customer Service Center at (800) 375-5283. If not, you can always make an INFOPASS appointment online to inquire at your local office in person. If you filed in California, it is taking between 7-10 months for these petitions to be decided.
