I got B1 visa when I was working for IBM in 2008. I am a Chartered Accountant in India, having 7 years of experience. Now I am intending to do CPA. I wanted to come there and see my future plans of settling there whether by CPA (if it is taking late to complete, donโt have an idea of its completion and risks). Please suggest whether coming there really serve my purpose by taking up the CPA path. I am really worried. Assuming my profession falls under specialty occupation. Also tell me whether as a chartered accountant, can I really get a job in some Indian companies(if I am not able to clear my CPA soon).
You cannot get a H-1B now because the quota has been filled. The earliest that a new petition can be filed on your behalf by an employer is April 1, 2016 with a start date of employment of no earlier than October 1, 2016 which is when the following fiscal year will begin. Please let me know if you have any additional questions or how I can be of further assistance to you in this matter.
Accountant can be a specialty occupation. You will need an employer to sponsor under next year's H-1B cap. Apply April 1 with a start work date of October 1.
Currently, there are no H1b visas available until October of 2016. You must also have an employer sponsor, who needs and will pay the 'average wage' for a CPA as determined by the U. S. Department of Labor. The process is complicated and there are risks that the visas will run out. That means that many employers may be hesitant to petition for H1b visas. For more information, I strongly recommend that you schedule an appointment with a competent and experienced immigration attorney who can afford to take enough time to explain the situation to your satisfaction. Good luck.
