Is your husband here with documentation or without? Many questions to be answered to properly advise you on the procedures, timing and fees and whether he is eligible to obtain permanent residency in the U.S. or will need to return home and obtain a waiver.

Before you file that, you really should have an initial consult with a competent immigration attorney to evaluate your husband's case and also to give you a better understanding of the process and correct procedures for you to follow.

If your husband is in the US, you can file an immigrant visa application with the adjustment of status application. This process takes about 90 days. If he is outside the US, then you start by filing the immigration visa petition (Form I-130).
