Asked on Nov 22nd, 2015 on Immigration - Pennsylvania
More details to this question:
I am currently married and living with my wife because we couldn't afford to get divorced or separate. I met a girl online from Brazil we want to get married so I scraped the money together to file for divorce from my current wife and my Fiance will be coming to visit for the first time in July of 2016 on a tourist visa, is it possible for us to get married and have her stay instead of just visiting

You must first be divorced from your current spouse. It is important that you make sure the divorce is finalized not simply filed before marrying your fiancé. You may marry your fiancé while she is in the United States for a visit, but she would need to return to Brazil for visa processing. A person cannot enter the United States on a tourist visa with the intent to marry and remain here permanently. This is material misrepresentation and can trigger a permanent bar to admission.
