How do I petition my step-son who is in Mexico?

More details to this question:
I am a US citizen, I am petitioning my step-son who now lives in Mexico. He doesn't live with his mother but he lives with my husband's aunt. How can my husband get full custody of him?

Assuming that he is a minor, you should be able to file an I-130 to begin the process for consular processing.

First, your husband needs to get a court order or a notarized letter from the mother allowing him to take his son to live in the United States. If the son was born out of wedlock, your husband will also need to submit evidence of legitimization before his son's 18th birthday. The petition is submitted on form I-130.
