Asked on Nov 20th, 2013 on Immigration - New York
More details to this question:
As I am talking, I have no idea where she lives at. I found out through Facebook that she is in a relationship with someone and even have a baby. All these arguments started a month after I have received my conditional green card. The card is expiring November next year. I have no clue where she lives at. She moved out from where we used to live. I need your help.

You will have to get divorced if you are no longer in a bona fide marital relationship and then file for the removal of conditional residency on your own.

Find an immigration attorney: this is not a subject that you can discuss on an open forum.

Well, it sounds like your marriage is irreparably broken, since you don't live together, you don't know where she is, and she may have even had a baby with someone else. If that's the case, you cannot remove conditions from your green card (unless, of course, you can show that she abused you in some way, and simply moving out or not wanting to be with you anymore is not really "abuse" from the immigration standpoint). So I am sorry to say, I do not see how you can remove conditions under this scenario. Generally, you would have to basically go home to your home country because your U.S. citizen spouse no longer wants to be married to you.

If you are divorced you may self-petition to remove conditions with strong proof that the original marriage was in good faith.

You should hire an immigration attorney. If you obtained your green card on a conditional basis, you need to file a Form I-751 to remove the conditional status within 90 days of second year anniversary of the date you obtained your green card.Ordinarily, you are supposed to jointly file the I-751 with the U.S. citizen spouse who filed your petition. But as I understand it, you cannot locate your wife and your marriage appears to have broken down. There are exceptions to the joint filing requirement and depending on the circumstances, you may be able to file the petition without your wife. But this is not something you should attempt on your own. because, if your I-751 is denied, DHS will likely commence proceedings for your removal from the United States.
