How do I sponsor my father for his green card application?

More details to this question:
I am a US citizen, born in California and I am 24 years old. My parent came here as a government official not as a diplomat. He overstayed here after his service was terminated. Can I sponsor his application for a Green Card? He is not wealthy but financially independent.

Yes, as long as your father came to the US legally and can prove that lawful entry, you can petition for his permanent residence and he will be able to complete the process within the US.

You can file an I-130 and your father can file an I-485. His exact visa status that he overstayed will need to be reviewed some government officials do require some additional paperwork. You will need to show your past three years tax filings.

Yes, you can sponsor him. *Adjustment of Status* An Adjustment of Status Application must be filed. This application will hopefully have the end result of obtaining lawful permanent residency. Once it is filed, the work-permit will be issued in a few months. Afterwards, in about 6 months to 1 year, the final interview will be conducted. Should you want to retain my firm to send an attorney with you to the interview, we will be happy to do so.

Yes you should. You will file form I-130 for him along with form I-485. There are other forms associated with the process but you can get information online or retain a lawyer to do it if you can pay for it.

You can petition your farther by filing Form I-130. He will be eligible to apply for adjustment of status based on the facts you provide and can file his application concurrently with your petition.

Yes, you can file for him as an immediate relative. INA section 245(a) will forgive the visa overstay and allow him to adjust his status here in the US.

You can file an I-130 petition for your father and he may be able to file an application for adjustment to permanent resident at the same time as your immediate relative. He should consult an immigration attorney.
