QUESTION

How do I withdraw my support for family based petition?

Asked on Jul 02nd, 2013 on Immigration - California
More details to this question:
I have petitioned my mom, who I never lived with, to live with me in the USA. I thought we can get to know each other and my son will have a grandparent figure. I also wanted the support of having a family member since I have no family to help me with my son. Well, visa got approved and she has been here for two months but we do not get along. She has mental illness that I did not know about and I can't trust her with my son. I told her its not working out, that I would buy her a ticket back home, but she wants to stay and make money. I no longer want to live with her and I know she won't be able to hold a stable job due to her condition. What can I do?

Unfortunately once her petition was approved and she entered the US, it is no longer your place to seek to withdraw or revoke the green card you filed for her.

I am so sorry to hear about your mom and your situation. As for withdrawing the petition, I am not sure that you can withdraw the petition. You filed a petition for her and she was granted an immigrant visa, so I am assuming she is a lawful permanent resident now. You can force her out and not have her live with you, but her Green-card is something you would probably not be able to cancel.

Unfortunately, you have entered into a contract with the US government to be responsible for her if she gets means tested financial assistance. Your commitment will expire in 10 years, or when she naturalizes.

You are not allowed to withdraw after the person is in the US. It will expire after she has had her green card for ten years or if she becomes a US citizen.
