QUESTION

How do we overturn a deportation?

Asked on Nov 24th, 2013 on Immigration - Texas
More details to this question:
I have a friend who was deported two years ago, back to Iraq. The reason for the deportation was an illegal marriage to a woman who is a US citizen. They were married in Turkey but she never divorced her previous husband. He served with the US Army Special Forces during the war in Iraq as a translator. Most of his family is living in the US now and he just wants to come back and be reunited with them. He was given a 10 year deportation and I am trying to help him find a way to get that overturned so he can come back. He lost everything when he was deported, i.e. money, vehicles, etc. and has very little money now. Can someone please offer some advice? Thank you.

Not suitable for a public forum - he or you should retain an immigration attorney to evaluate the facts of his case and his current equities.

What you should do is to find a well recommended immigration attorney who will agree to take this case. A deportation order is very difficult to overturn, especially if it was based on alleged marriage fraud.

Your friend can try to come back to the U.S. by applying as a translator who worked for the U.S. government during the Iraq war. If his application is approved, it is likely he will be required to file 2 separate waivers: an I-212 waiver because he has been deported before and a I-601 waiver because of the fraudulent marriage. In order to qualify for the waiver(s), he will need to establish extreme hardship to his parent(s) or spouse who are permanent residents or citizens of the U.S.
