QUESTION

How does Temporary Restraining Order affect immigration status?

Asked on Oct 31st, 2014 on Immigration - New York
More details to this question:
I am filing for divorce from my husband. He is unwilling to move out. There is history of domestic violence and I am told that Temporary Restraining Orders (TRO) can make him move out. However, I would like to understand how does TRO affect his immigration status? He is currently on H1B and is undergoing the PERM process. Is it true that he will not be given EAD or Green Card once he gets a TRO?

No. A TRO will not affect his EAD eligibility. If he is not convicted of any crimes his immigration application will not be affected either.

TRO in itself does not affect his status. Criminal charges do.
