QUESTION

How long can an application for working visa in the US take?

Asked on Feb 28th, 2013 on Immigration - Mississippi
More details to this question:
I am a dual citizen born in the States and my wife and I are curious about moving and working in the United States. She is from Belgium and we are curious how difficult and long the process of applying for a work visa for the US can take. We are not interested in Citizenship as we are both Europeans citizens and will probably split our time between the US and Europe.

You have to be petitioned by an employer on the basis of a valid job offer. That is the only way you can qualify for a work visa. The process can take a few months or a few weeks for additional fees.

Rather than attempting to get a non-immigrant working visa which requires sponsorship by a US-based employer, her best option would be to seek lawful permanent resident status (I-551 LPR) through your sponsorship of her as her US Citizen spouse. If you are both residing in Europe at this time and have been residing in a US Consular District together for at least the past 6 months the process can be done through the appropriate US Consular Section within which you have been residing. You should consult with an experienced immigration attorney to guide you through the process.
