How long can an immigrant be kept in jail while waiting for ice to pick him up before he is released?

My dad has been in jail for a week and a half but every time I call they say they are waiting for ice to pick him up. I called ice and they said that they always pick them up within 48 hours. What happens if they don't go? Is he supposed to get released?

Your father could file for a writ of habeas corpus to challenge the state's authority to hold him.
