How long can I stay after my R1 is expired?

More details to this question:
I am currently on R1 visa but I have an offer from a company for a job. The company is willing to apply for H1B for me. What is the grace period I can be unemployed during the process? Can I keep staying in the US? Also, when can I start working for the new company? Do I have to wait until the H1B is approved?

You will have to leave since the cap has been reached. If you overstay for more than six months you will have a three year bar from returning.
