How long do I have to wait before I can help my second husband get his papers?

More details to this question:
I have been divorced for almost 4 years and I have been with my boyfriend for 3 years talking about marriage. He is an illegal immigrant. I want to know how long I would have to wait after helping my first husband get his papers to help my soon to be husband get his.

You may file application for your current or new husband anytime. However, if he is illegal or entered without inspection then he may need to go back to his home country to process the application.

The two cases are unrelated as long as both were bona fide relationships and not for immigration purposes. You and your boyfriend should get a consultation though to review his complete immigration history, method of entering the U.S., other qualifying relatives, and criminal record, any returns to the home country, etc. to assess what the process will be to obtain his permanent residency through your marriage and whether he will be able to file here or will need to return home and apply for a waiver or whether neither option is open to him.

If he has no status see a lawyer before filing. You could file now but you may not be able to have him adjust in the country.
