QUESTION

How long does an application for change of status have to be reviewed?

Asked on Feb 28th, 2013 on Immigration - Michigan
More details to this question:
I acquired the services of a known lawyer and he told me that I can possibly adjust my status because I was checked and accepted legally when I entered the United States. But until now, I have no idea if my application has been filed. I already paid the non-refundable initial payment and a couple thousands more. I have been emailing them and all they say was "my case is being reviewed".

It is difficult to answer this questions without more information. In what classification did you file? Was it an employment or family case? Also, when was the case filed? Just because you entered the U.S. with status does not automatically qualify you to change your status or adjust your status.

Lawyers are not permitted to call payments non-refundable. If you think he is not doing the work you paid for, you should make a complaint to the disciplinary board in your state. In Colorado, that is with the Colorado Supreme Court.

You should ask for copies of all papers and receipts filed in your case from the lawyer. You can then check on the status on the Internet.
