QUESTION

How long does humanitarian parole take?

Asked on Aug 05th, 2011 on Immigration - California
More details to this question:
My lawyer is filing the paperwork for humanitarian parole for my fiance that got deported three months ago to mexico and he's the one that supports his mother. His permanent resident mother has parkinson disease and she's getting worse. Her social security was denied and is going through a hardship. Once my fiance gets the completed humanitarian parole paperwork, the lawyer that we hired said to take it to the border and hopefully they grant it. Is that even possible? and if so how does that work? Will he be able to come in to the USA?

I am not aware of any "humanitarian parole" for someone who has been deported 3 months ago. The standard of humanitarian parole is very high and CIS must weigh positive and negatives of the case, the government interest and policies, etc. etc. and I have seen it hardly to be granted. When you say fiancé, I assume that you are going to get married. And if so, maybe your lawyer should think about other avenues to bring your fiancé back.

Typically 3-4 months but can be expedited with "good cause." I cannot comment on the merits of the case without a lot more information.
