How long does it take to get a green card?

Asked on Aug 22nd, 2011 on Immigration - California
More details to this question:
I am a Chinese mainland citizen and recently married to my husband who is a U.S. citizen. We are filing my I-485 this week and I am wondering how long will it take for the green card approved. Should I apply I-765 now together with I-485 if I want to start work in this December?

It will take about 4 months. There are more than one form to file for adjustment of status. You should consult with an immigration attorney. The money you spend with a professional is well invested to guide you through the process so you can timely start working.

It takes generally about 3 to 4 months for you to receive your green card. You should apply for a work permit with the I-485 since the filing includes it anyway. The same applies to a travel document but you should not leave the US while the application is pending if you accrued unlawful presence for more than 180 days.

Assuming you entered legally in most areas it is about 4 months until your interview. Your I-485 includes fees for the work and travel permits so definitely include the I-765 paperwork and I-131 if you are eligible to travel . These are complicated cases and I recommend you retain an attorney to advise you and oversee the process.

It takes about 4 months from the time of filing to the time of the interview. Most people get approved on the day of the interview if everything is in order.

Depending on the location, it may take about 3-5 months. You should apply for EAD if you plan to work as the process may take longer.
