QUESTION

How long will it take for my I-130 to be processed?

Asked on Jan 03rd, 2015 on Immigration - New York
More details to this question:
I'm a US citizen. I filed for my wife I-140 in February 2014. I am still waiting for approval. Last letter I got from USCIS is saying my back ground is not done. How long does it take? Thanks.

Several details you mentioned sound peculiar: a U.S. citizen may file forms I-130 and I-485, but not form I-140, for a spouse to become a Permanent Resident (to get a "Green Card"); there is no background check of the U.S. citizen spouse, just of the beneficiary who seeks to become a Permanent Resident; and eleven months is outside of the USCIS's normal processing time for marriage-based adjustment of status applications. It would be wise for you and your wife to engage an immigration attorney who could review the pending applications and then advise you about options for seeking the USCIS to complete its adjudication.

It all depends. But it seems a little long, so call them or involve your Senator's office to follow up on the petition.
