Husbands Immigration bail/bond questions

Asked on Aug 19th, 2011 on Immigration - Wisconsin
More details to this question:
My husband was put in ICE custody, and was given a 5,000 bail. He said that if he doesn''t pay that soon, then he wilol be sent to court and the judge may lower the bail, or release him alltogether. HOW could we speed the process? OR is there something I can file or do to help him get out faster? We have been married 5 years, and now have a 2 month old daughter. He wants to get out soon so he can be with his daughter... He was sent to jail cause he violated a DUI probabtion stipulation by drinking. Idk if it matters but it never hurts to add all the info. He went to court today and the judge said he was under INS hold and would wait for them to do what they wanted first, then start the alchohol counseling and Probabtion all over again if he was released. But like i asked...IS there anything I can do to help him? Thank you

The fastest way to get your husband released from ICE custody is to pay the $5,000 bond.  He can request a hearing to ask the Judge to lower the bond, but I recommend that you contact a local competent immigration attorney to determine if the local Immigration Court requires a motion for bond redetermination.  In general, the Judge will lower the bond as ICE generally sets an unreasonably high bond, but rarely will the Judge release someone without a bond.  Good luck!
