Hello, My Lawyer received a Notice of Intent to Deny (NOID) on the I-140 petition filed by my company on behalf of me. This is EB2 category. The issue is the degree equivalency. I have completed 3 years of Bachelor degree and 1 year of master’s degree from same university(INDIA). Also have 9+ years of experience. Also have 2 years of diploma in computer application. Got the NOID – “Evidence that the beneficiary possesses the foreign equivalent of US baccalaureate degree”. My education evaluation done by foreign transcripts – they mentioned my education in the United States equates to the Bachelor of science in Business administration degree – Management. But still we received the NOID in I – 140 process. What are the further steps we can take on this to reply the NOID? Appreciate your help on this.

Your best bet is to discuss the issue with the attorney handling the Form I-140. He/she has access to the entire file and therefore, in the best position to provide guidance. If you want a second opinion, you should take the complete file to an attorney for review.
