I am a USA citizen, Want to marry my girlfriend on B2 visa with J-1 2 year restriction. 4 more month left on 2 yr J-1 restriction.

I am a USA citizen. My girlfriend is on B2 visa now in USA and we would like to get married and change her status. She was here in USA 2 years ago on J1 visa. She only need 4 more months stay in her home country to satisfy 2 year restriction on J1. We would like get J-1 2 years restriction wavier, then get married and change her status. Is this a possible and a correct path to go? Or should we get married in USA and she go back to China for 4 more month then we apply for marriage visa for her? Thanks
Hi. You can do either option. The waiver will take more time and money. You can marry and file the case after the 4 months in China or marry, file the case and have her wait for the immigrant visa processing in about 10 months. Or, you can file the waiver and then the case in the US while here on the B2. The most efficient would be to wait the 4 months and then process (assuming her B2 is still good).
