Although the immigration laws are becoming more strict where DUIs are concerned, one DUI and a license suspension would generally not be enough to derail an immigration case based on marriage to a US citizen as long as the relationship is bona fide.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. A single, basic DUI probably won't be an issue. But, if there were other factors involved (multiple offenses, harm to people or property, other criminal record, immigration violations), then it could possibly create difficulty for you. You should consult with a competent immigration attorney.
If you have been married to a U.S. citizen for nearly 3 years, then why have you not yet applied for a green card? What is your status now?
