I applied for my parents B visitor visa extension and got a confirmation receipt number from USCIS. I know my parents can stay in US till USCIS approves/denies visa , but my parents want to leave US for personal emergency. My question is can they move out of US before USCIS confirms visa approval or denial ? I know they need to complete biometrics if their visa is approved, but they do not want to wait till biometrics date . Can someone suggest whether this will cause any issue in future if they want to visit US again ? their current I-94 is already expired.
It is our understanding that persons who file for timely B-2 extensions and leave the US while the applications are pending should not suffer any adverse effects when they later attempt to visit the US again. They should also not have their visas canceled as long as their applications were nonfrivolous.
