I am a US Citizen who married a foreigner in 2010 and was divorced the same year. I got a call from Homeland Security saying they have a few questions about the paperwork we filed. He said he would come to my house Thursday. Is it ok for me to talk to him or should I get a lawyer?
The DHS officer would most likely be looking into the question of whether there was fraud in the petition that you filed for your ex-husband’s permanent residence. This may be in connection with his application for removal of the conditional basis of residence status, his naturalization application, or petition for another spouse. If everything was on the up and up and you have proof of the bona fides of your marital situation, it would perhaps be OK for you to talk to him without a lawyer. Otherwise you may wish to have an attorney present at the time of your interview with DHS.
