hello, in May 2020 I applied i130 for my wife who's currently abroad. Unfortunately my wife's life in danger because there is unrest possible civil war. Last month a group of armed men come to my wife's neighborhood and beats up threatened them. Some were injured. The authorities were called but they always side with current ethics power. The state department put level 4 in that country because of how danger the country especially right after thier election each party announcing victory. People are getting killed. So my question is can I request expedite processing for my wife and if so how can prove that what's going in the country in paper in case they ask for evidence? Thank you in advance
A petitioner may ask USCIS to expedite the adjudication of an application or petition for an immigration benefit. USCIS:
Considers all expedite requests on a case-by-case basis.
Requires documentation to support a request.
Has the sole discretion to decide whether to grant or deny a request.
Does not consider expedite requests for applications or petitions that have Premium Processing Service available.
If a case like these you probably can argue humanitarian reasons. You will need to collect evidence of the internal situation of the country at issue and of the particular circumstances of your wife to support your petition. Depending on the current status of the process, the possibility for USCIS to expedite the process changes.
