I filed I-130 for my parents and received receipt notice on 5/2/2024. Then I mailed I-485 application to USCIS Chicago lockbox on 5/13/2024. The application package was picked up by USCIS staff on 5/16/2024. It has been more than 30 days, we still haven't received receipt notice and check is not cashed either. My parents' B2 visa (I-94 date) is expiring in 2 weeks (June 30). What should we do in this situation? 1. If we have received an I-130 receipt, does that mean my parents can stay in the US up to 240 days while waiting for their I-485 receipt notice?, or 2. Does USCIS go with the date of I-485 application mail package is picked up at lockbox or the date of receipt notice mailed out to us?, or 3. Do we need to file another I-485 application or file I-539 for non-immigration status extension?, or 4. Do my parents need to leave the US before 6/30/2024 if we don't receive receipt notice by then?
A US Citizen child over 21 can sponsor mom and dad for green cards if they entered the US legally. This is despite that both are or will be in overstay status. It is not uncommon that the checks for USCIS filing fees have not been cashed after 30 days. There are many backlogs at most field offices so remain patient.
