I got married in September 2013. In January I had an interview and was aproved for a green card. I just got it 2 weeks ago. I also just found out I am pregnant. My husband doesn't want kids and he is telling me to get an abortion or that he will file for a divorce and give up his paternity rights. I am not going to abort my baby. That is not an option. I asked him to go to marriage counseling with me but he refuses. He moved out. If we get a divorce what are the chances I can file I-751 on my own with a divorce waiver and get aproved considering we were only married for a couple of months?
If you are divorced, the chances are that you can file an I-751 successfully by yourself if you have the baby and explain to U.S.C.I.S. the reason for which your marriage failed. The agency only looks to see whether there was a bona fide marriage. According to the facts as you relate them, your marriage was real and there are legitimate reasons for which it has failed.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
