If my mother is a US citizen and I was born in Mexico, am I a US citizen?
Asked on Jun 24th, 2014 on Immigration - California
More details to this question:
My mom was born in the USA, I was born in Mexico. My parents were married before I was born. My father was illegal, born in Mexico and my mother never registered us as citizens. I was born in 1978 and my sister and brother were born in 1980 and 1982. Can we apply now for citizenship even if mother has passed away?
You might already be a U.S. citizen but you need an experienced immigration lawyer to make the necessary calculations based on the U.S. nationality law at the time of your birth.
More complicated than these facts. Need to know how many years your Mom lived in the U.S. before you were born and how old she was when she lived here, etc.
I would need to more details to say for sure. Talk to an immigration lawyer about "derivative U.S. citizenship." It all depends on how old your U.S. citizen mother was when she gave birth to each of you and how long she lived in the United States before she moved Mexico.
