More details to this question:
One of my known family friends filed for amnesty 25 years ago using a different name but returned to the home country and didn't come back for renewal , the finger prints were taken at that time. So if that person watns to come visit US now , will his identity still be in the US records when he enters immigration on the airport and the finger prints will be present in the records , as these were used under different name. Please advise if the records which the brown card was given but never renewed would still be active and whether the person can be identified during immigration ?
Under these circumstances, no one can rule out the possibility that the border patrol will make the connection between the amnesty filer from 25 years ago and the person trying to cross the border at the moment. In any case, if the amnesty filer had been in the US without authorization for a lengthy period, he or she would be barred from returning for 10 years unless they could show extreme hardship to a US citizen spouse or child. A waiver of that ground of inadmissibility is available at a US consulate.
