Is a contract binding even when there is no resolution?

More details to this question:
My Mexican spouse and I signed a contract a year ago with an immigration attorney and paid $400 with a balance due of $800. The attorney filed for a document that was never produced. She does not know why, "it may have been lost". She suggests that we file a lawsuit but we have no funds. As an American citizen I moved back to the States to hopefully find employment. She is now expecting the balance be paid. What are the ramifications of non payment? We have no assets. Can the attorney report breach of contract to credit agencies?

It will really depend upon the language of the contract and what work was undertaken. The attorney may be able to sue you for the balance owed. If a judgment is made against you, this could be reflected in your credit report.
