QUESTION
Is G-325A needed for citizen sponsoring parents?
Asked on Jul 16th, 2013 on Immigration - California
More details to this question:
I am a US citizen sponsoring my parents for permanent residency. I know my parents need to submit the G-325 form, but do I need to submit one as well? If I do need to submit it, could you please let me know to which form it needs to be attached to? I did not read anywhere in the 485 instructions that I need to submit the G-325 for myself as a US citizen.

There are many shortcomings to the instructions provided by the USCIS. The USCIS Atlanta Field Office requires that both the petitioner and the beneficiary submit Forms G-325 with an adjustment of status application package. These types of details may not be apparent, but failure to comply with them can result in significant delays or even more harsh consequences, and it would be wise to engage an immigration attorney to assure that a case is properly prepared and fully documented.

It is advisable that you submit your own G-325A Biographic form in addition to the one your parent/ beneficiary must submit. It is a one page form in which you provide relevant information about yourself and it does not have to be atached to any other particular form. No fee is required for this form and is only for purposes of data collection and comparison with information you may have provided to DHS or other government agency in the past about yourself.

This, among other issues, may not appear in the instructions. You may slowdown application processing time by months if other issues seem unresolved in the opinion of the adjudicator. Good luck.

You need to submit the G-325 for the petitioner and the beneficiary as part of the I130/i485 packet. Please let me know if you have any additional questions or how I can be of further assistance to you in this matter.

Yes, as the petitioner, you have to submit Form G-325. Put it in front of your parents' G-325s in the packet.
