QUESTION

Is my husband able to come back to the US?

Asked on May 18th, 2012 on Immigration - Georgia
More details to this question:
We are both 20 years old and this case took place in Georgia. He was charged with consuming/possession of cocaine. I want to know if it is an aggravated felony, if he has a chance to come back, and how long is the bar for? He is from Chile and the judge told him he can get the voluntary departure but we did not have enough money for it so thats why he is getting deported. We are legally married and he has been here since he was 3 years old. He doesnt know anybody back in his country and he came with a visa.

I think you should consider the voluntary departure. This is a serious matter and whatever you do today may affect his chances to return to the U.S. in the future. If your husband was convicted with felony, he is not eligible to come back to the U.S.
