QUESTION

K1 Visa denial, next step?

Asked on May 05th, 2016 on Immigration - Washington
More details to this question:
I filed for fiance visa but it was denied due to not being able to fulfill the stipulation of having met my fiance within 2 years prior to filing. It was just 2 months shy from 2 years. I decided to go ahead and file because I thought my reason was valid. I had lost my green card the last time I went home then after getting a replacement, I went ahead and filed for my citizenship. So my question is should I withdraw my previous petition, go home and refile or get married there then petition him as a spouse? Thanks in advance for the advice.

Your petition has been denied so there is no need to withdraw it. Visiting your fiancé and the re-filing or marrying while overseas are both viable options. It really depends upon your personal choice. The fiancé visa petition tends to be little faster to get someone to the United States but there is still process that must be completed once he/she is here in order to be a resident. When your have married and your spouse enters with an immigrant visa, he/she is a resident from the day of arrival.
