QUESTION

minor on B1 visa needs to stay longer

Asked on Mar 02nd, 2016 on Immigration - Illinois
More details to this question:
I have a 14 year old we invited to visit the US on a B1 visa for 2 months and just found out that his Mom is in a situation financially and more with her 3 other kids that can not take care of child properly so we offered to take him for a year and Mom is sending me a guardianship letter signed by an attorney giving me guardianship of child for a year. Child needs to go to school while here, what can I do so it is legal? I read that if situations like that minors can go to school under B1 and I need to file paperwork, but not sure what. He is not staying forever and does not want to become a citizen, will go back as soon as Mom is better .Our school would take him since I would be the Guardian and he would live with us, but what do I do about the Visa and what are the fees?

Assuming the child is still in his authorized period of stay, a request to extend his status must be filed. If his period of authorized stay has already expired, he would not be able to extend his stay in the United States. He would need to depart the country and re-enter on a valid visa.
