The crime is against me and requires a minimum sentence of 15 months in prison. Our marriage of 10 years is not healthy. We live separately and I have almost no trust in him. I have given him about $100,000 directly for tuition and indirectly he has cost me another $50,000. He has multiple graduate degrees and a nearly complete graduate degree from a top university. He refuses to work long in a low paying job. He has only had a few jobs and never been employed for more than two weeks. He is in the last stage of obtaining his citizenship, the final application, but has not submitted it even though he has been eligible for several years. At one time he hinted that he may not get the citizenship. I would like to know if I will be liable to pay the local or federal government any expenses that are incurred due to a police report and any consequences of a conviction, because I signed the affidavit of support. Can a conviction result in deportation?
A conviction based on a crime involving moral turpitude can certainly be a basis of deportation dependent upon the type of crime, amount involved, time that the individual could have served, and the time to which the individual is sentenced. On your other question, you would not be liable to pay expenses incurred due to a police report and any consequences of a conviction just because you sign the affidavit of support. That liability only comes if your husband took means tested benefits.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
