I am a US citizen. I married my husband on March 1, 2019, who is from Mexico and was here on an F1 student visa. He graduated with his Masters in Mechanical Engineering on May 1st and applied for OPT after that. His OPT was approved on August 26th, so he has until November 26 to find employment. He has applied to many, many jobs, but is still struggling to find employment. We are planning on filing a marriage green card application for him soon so that once his OPT is done he will have a green card. On the off chance that he is unable to find employment before November 26th- would he be able to stay in the US while we wait for the green card application to be approved? I thought that students who were here on an F1 visa and got married could transfer to a marriage visa applicant and legally stay in the US while the green card application is being processed? Is this true and does this also apply to OPT?
