QUESTION

P1 visa transfer

Asked on May 02nd, 2016 on Immigration - Pennsylvania
More details to this question:
My friend came to USA from Ukraine with a three-year P1 visa two years ago. His contract was prematurely terminated in End-November, 2015. His employer offered him a ticket to Ukraine and he used it to go back to Ukraine in mid-January 2016. After a 3 month long home visit, he came back to USA in Mid-April 2016, using the old visa. His former employer has not notified the immigration office of the employment termination because my friend begged them not to. Now he is in the process of filing a visa transfer with a new company. He does not look good with no recent pay stubs, no activity to put in his resume for the period of September 2015 and April 2016, a sudden employer change after a long vacancy from USA. Does he have a chance to get his visa transfer granted? I am more afraid of him being deported and banned for entry to USA in the future.

Your friend really needs to consult an attorney. Transferring any nonimmigrant employment visa requires a showing that the person previously complied with his/her status. Filing for a transfer may not be the option.
