QUESTION

Permanent resident status

Asked on Jun 18th, 2016 on Immigration - Pennsylvania
More details to this question:
In 1995 i came to USA with my parents and brother from Ukraine. My father recieved asylum status AS-6 green card, rest of us AS-7. In 1999 I joined USMC. In 2001 I went AWOL left USA back to Ukraine. In 2015 I turned myself in, by phone. My green card was expired, so US embassy in Ukraine issued me a entry permit valid for 3 months, "public benefit". While in military, waiting on decision for my request to be allowed to stay in military and finish my 4 years contract, I filed for green card renewal. I was approved and issued a new green card. Shortly after, military command denied my request to finish contract and shortly after I was discharged from USMC in lieu of court Marshall for AWOL (desertion was never considered, I kept my military ID). Now I am a truck driver. I filed to USCIS for immigration visa for my two kids and wife that are in Ukraine. My application was approved 2 month ago. They are waiting for visa availability. My concern is, can I be stripped of permanent residence?

Quite honestly I am surprised you were not found to have abandoned your residence given the information provided. Permanent residence is not permanent. There are a variety of reasons one could be stripped of his/her residence. You risk losing your residence due to abandonment. Unfortunately, you can only wait to see what happens. You need to do what you can to build ties to this country. You can read more about family immigration at http://myattorneyusa.com/family-immigration.
