QUESTION

Permanent resident vs B2 visa

Asked on May 27th, 2016 on Immigration - North Dakota
More details to this question:
Hi, currently my parents are permanent resident of USA. They are both over 65 years old. They Plan back to China live for a while(may over 2 or 3 years just come back visit me occasionally). so I guess the "Re-entry Permit" still can't guaranty them back to USA smoothly. Is any way they can exchange the permanent resident to a 10 years B2 visa? or just in case if they lose the green card in the future. Is it a lot trouble to apply a B2 visa then? Thank you.

You cannot convert lawful permanent residence to a 10-uear B-2 visa. Your parents need to apply for a re-entry permit. This is the best way to prepservce residence, but as you noted it is not a guarantee they will not be deemed to have abandoned their residence. Your parents would likely face difficulty obtaining B-2 visas in the futre if they abandon their residence unless they can establish very strong ties to China.
