QUESTION

Pregnancy Medicaid while being sponsored for green card

Asked on Apr 15th, 2020 on Immigration - Georgia
More details to this question:
Hello, I became a US resident last year and are scheduled to reapply for my green card early next year. My husband sponsored me to become and resident but needed my father in law to co-sponsor me since he did not have 40 working quarters. I am six months pregnant and my husband and I just lost out jobs due to Covid-19. I was wondering I could apply for Medicaid for the length of my pregnancy without affecting my sponsor. I also read that pregnancy waives being changed with the Public Charge Law and I will be able to reapply for residency with no issues but also needed clarification on that. Any guidance is very much appreciated.

Hello Viky, Thank you for your question.  Generally pregnant women are not subject to the 5 year bar in receiving Medicaid benefits.  Therefore, typically a pregnant legal permanent resident is able to receive Medicaid benefits during the term of pregnancy.  Pregnant women then revert to the 5-year bar once their pregnancy is over, if they have not yet been in qualified immigrant status for 5 years. Kind regards, Erin
