QUESTION

Question about H1B transfer

Asked on Nov 06th, 2014 on Immigration - Texas
More details to this question:
I had an employer ABC who transferred my visa but I couldn't join them as there was a recruitment freeze. Now I got a new job offer from XYZ and they just submitted my petition with USCIS for visa transfer . At the same time ABC reached out to USCIS for withdrawing their transfer petition . Would that be posing an issue to XYZ's visa transfer

Hi. If you are new H1b was filed before the other is withdrawn, you should be ok. You should speak your company attorneys also. You may need to expedite and pay the premium processing to ensure the change of employer instead of waiting and having USCIS deny because the 1st one was withdrawn.
