QUESTION
regarding immigration petition and government assistance
Asked on Dec 22nd, 2013 on Immigration - Virginia
More details to this question:
My mother petitioned my brothers years ago and it's still pending. The company that she worked for closed out a couple months so she was forced to retire. I advised her to get help from government (ie: EBT/food stamp, mortgage assistance, etc.) since her pension isn't much. My question is if she gets help from the government, would this have any affect on my brother's petition? She's 77 and paying her own condo. any advice would be appreciated. thanks

The question of whether the petitioner is taking means tested benefit is no longer on the I-864 affidavit of support form. Consular officers can still ask the question, but most would focus upon the credibility of a joint sponsor's I-864. I suggest having a credible joint sponsor with high income.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question.
