QUESTION

Regarding work eligibility on H1B status

Asked on Jun 10th, 2016 on Immigration - Washington
More details to this question:
1) Came to US on H4 and appled for H1B 2) H1b got approved in 2014 from comp A and in 2016 USCIS asked to revoke H1B which is now in Rfe stage and nor yet revoked. 3) Transfered H1B in 2015 to Comp B and denied In 2016 JUne 4) Meanwhile applied Change of status from H1-h4 and got receipt number in May. My question, I have a job offer in hand and I have start immediately. Now if I apply For a new H1B with new employer can start working immediately with receipt number or wait till it is approved. If I file new H1B , should I apply it as change of status or H1B transfer. Please suggest me what would be the better option in this case.

You likely cannot start working immediately given the information provided. The employer will likely need to file a new petition on your behalf. You will likely need to file a change of status or seek a visa abroad given the information provided. The employer's immigration attorney can provide case specific guidance as he/she will have to review the matter thoroughly to determine how to best proceed.
