Asked on May 05th, 2021 on Immigration - Texas
More details to this question:
My fiance filed I-129 F and DS-160. I came to the US with my 19-year-old as K1 and K2. After we got married, I filed for I 485 along with my daughter. The case is still pending. My husband passed away on Dec 31st,2020. Should I have to find someone to file I 30 for me?

The general rule is that if you have an adjustment application pending and your husband dies, USCIS will still process your case. There are exceptions to this rule so you should Retain counsel for advice regarding the particular facts of your case.
