QUESTION

Should I still apply for a working permit if I already have one?

Asked on Apr 07th, 2014 on Immigration - Texas
More details to this question:
I recently got married to my U.S. citizen wife and I am trying to apply for my green card. I already have a working permit through DACA and it won't expire for another couple of years. I did enter the country legally and have my I-94. Should I resubmit form I-765?

The $985:00 fee paid for your adjustment application already includes a work permit, but if you already have a work permit, it may not make sense to apply for another work permit. It is just my opinion and I understand others may feel differently.

Yes, you will be eligible for a work permit under the AOS filing. It does not cost extra because it is included in the AOS filing fee.

If you already have a work permit issued through DACA, you are not required to apply for another work permit on the basis of your application for adjustment of status. However, it may be advantageous for you to do so because there is no separate fee for the application when you submit it at the same time or subsequent to the filing of your I-485 application. There is also no fee to renew the permit every year as long as the I-485 application is still pending with USCIS.

There is no reason to do another I-765 if one already has a work permit through DACA, unless you live in a state that discriminates against DACA-coded work permits
