More details to this question:
If my biological father changed his name and he has stayed here for 20 years without a visa in the United States and the only documents that I have is to show is a birth certificate that he is under his old name, will the burden of proof from the petition come from me since I am a US Citizen? I don't want any fraud or problems for me.

Hello. The burden of proof would be on your father to prove he is who he claims to be.  There are seveal ways to prove this from sworn affidavits through dna testing from his parents. My office has assisted several clients in the same situation. Call my office for a free consultation.
