QUESTION

To what U.S. consulate will the approved petition go?

Asked on Mar 14th, 2014 on Immigration - California
More details to this question:
My wife and I got married in India. I'm a U.S. citizen currently living in the U.S. and she is a British resident currently living in the UK. I'm filing an I-130 petition for her now. Once the petition is approved, will the NVC send the petition to the U.S. Embassy in UK or India?

If your wife is a UK citizen, and assuming you designated UK in the form I-130 petition, her immigrant visa interview will be in UK. If she is a dual citizen of UK and India, the immigrant visa interview can be processed either in India or UK.

It will send it to wherever you indicate you want to have consular processing done. However, keep in mind that you cannot just forum shop for a consulate. There has to be a logical and reasonable nexus between where your wife is living/working and where she will be consular processing.

What address did you list as her permanent address? Provided you did everything correctly and she is a British resident, she should be able to go to consulate in Britain. You may check with the consulate yourself.

if she is a permanent resident of UK, you can request the file be transferred to UK, which will be faster to process.
